General Conditions of Sale

Preamble


The General Conditions of Sale below apply to the sale of guided tour services provided by the individual company :

In accordance with the regulations in force, Emanuele Santi holds the professional guide-lecturer card n° GC 23-74-004 P, issued by the French Ministries of Tourism and Culture.

The Customer declares to accept the following provisions by placing an order for a service. Placing an order implies on the part of the customer full acceptance of these general conditions of sale, as well as full legal capacity allowing him to commit to these general conditions of sale.

​

These general conditions are accessible at any time on the site www.lemanvisites.com (below the “Site”) and can be communicated if requested from the customers. They may be modified at any time and their modifications must appear on the Site.

 

Article 1 – Booking of Services

 

1.1 Booking Procedures

A guided tour may be booked via the “Booking Request” form available on the Website.

The Client may also request a personalized quotation, particularly for a tailor-made tour, via the contact form on the Website or by email at info@lemanvisites.com.

 

1.2 Information about Services

In accordance with Article L.111-1 of the French Consumer Code, the descriptions of services set out their essential characteristics.

This information is provided with the utmost care to ensure it is as complete as possible; however, it is not exhaustive. Photographs, illustrations, and descriptions displayed on the Website are for informational purposes only and are not contractually binding.

 

1.3 Validation of the Booking Request

The Client selects the desired service, date, and meeting time in the booking request form.

The request may only be submitted after the Client has expressly accepted these General Terms and Conditions by ticking the designated checkbox.

 

1.4 Confirmation and Formation of the Contract

The Client will receive a confirmation of availability by email within a maximum of 24 hours, specifying the payment terms required to finalize the booking.

The contract is deemed definitively concluded only upon receipt of an email from Emanuele Santi EI confirming acceptance of the booking.

Emanuele Santi EI reserves the right to refuse any booking request without having to provide justification.

Article 2 – Prices

​

2.1 Scope of Prices

The prices include exclusively the guided tour service, unless otherwise specified.

​

2.2 Applicable Prices

Services are provided at the rates in effect at the time of booking confirmation.

Prices are indicated in euros and expressed as net amounts. VAT not applicable – Article 293 B of the French General Tax Code.

​

2.3 Price Modifications

Emanuele Santi EI reserves itself the right to modify prices displayed on the Website at any time. However, the Client will only be charged the price agreed upon at the time of booking confirmation.

Obvious pricing errors may be corrected at any time with effect for the future.

Article 3 – Payment Terms

 

3.1 Payment for Website Bookings

Bookings made via the Website must be paid through a secure payment link or by SEPA bank transfer.

​

3.2 Payment for Bookings Based on a Quotation

For bookings confirmed by quotation, payment must be made by SEPA bank transfer. Bank details will be provided upon receipt of the signed quotation from the Client.

​

3.3 Payment Requirement

The service will not be provided until full payment has been received in accordance with the above conditions.

​

Article 4 – Cancellation and Refund Policy

​

4.1 Cancellation by the Client

In the event of cancellation after booking confirmation or signature of the quotation, the following conditions apply:

  • Up to 15 calendar days before the start of the service: full refund.

  • Between 15 calendar days and 48 hours before the start of the service: 50% refund.

  • Less than 48 hours before the start of the service or in case of no-show: no refund.

 

4.2 Cancellation Procedure

Any cancellation must be notified by email to info@lemanvisites.com and must include:

  • Client’s full name

  • Booking details

  • Bank details for the refund

 

4.3 Refund Procedure

Refunds will be made by bank transfer within 7 days after receipt of the required information. A credit invoice will be issued.

 

4.4 Cancellation by the Guide

In the event of cancellation by Emanuele Santi EI, the Client may choose between a full refund or rescheduling the tour for a later date, subject to the Guide’s availability. No additional compensation may be claimed.

 

4.5 Circumstances Beyond the Guide’s Control

If the service cannot be performed for reasons not attributable to the Guide (exceptional closure of a site, weather conditions, strikes, demonstrations, etc.), a solution will be proposed on a case-by-case basis: rescheduling, modification of the tour, or partial/full refund.

No additional compensation may be claimed.

Article 5 – Performance of the Service

 

5.1 Attendance of the Parties

The Guide undertakes to be present at the agreed date, time, and meeting point.

The Client likewise undertakes to be present under the same conditions.

 

5.2 Delay or Absence of the Client

In the event of delay, the Client must inform the Guide by telephone.

For private tours, the Guide will wait for a maximum of 30 minutes after the scheduled time. The duration of the tour will not be extended in the event of delay.

If the Client fails to appear and provides no information within 30 minutes after the scheduled start time, the tour will be considered cancelled and no refund will be issued.

 

5.3 Weather Conditions

Tours will take place in case of rain, unless the Guide decides otherwise for safety reasons.

Article 6 – Liability

 

6.1 Governing Law and Jurisdiction

These General Terms and Conditions are governed by French law.

In the event of a dispute, French courts shall have exclusive jurisdiction.

 

6.2 Liability During the Tour

Participants remain under their own civil liability during the tour.

Emanuele Santi EI shall not be held liable in particular for:

  • Theft, loss, or damage to personal belongings;

  • Personal injury or material damage suffered by the Client or participants;

  • Damage caused by the Client or participants to third parties;

  • Damage caused by the Client or participants in museums or visited sites.

Article 7 – Confidentiality and Image Rights

 

7.1 Photographs and Publications

Photographs and videos may be taken by the Client during the tour, subject to compliance with the rules of each visited site.

If such images are published online or on social media, prior consent must be obtained from all persons concerned, including the Guide.

 

7.2 Recording Prohibition

Any audio or full video recording of the tour is strictly prohibited without prior written authorization from Emanuele Santi EI.

Article 8 – Consumer Mediation

 

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, Emanuele Santi EI has established a consumer mediation scheme. The designated mediation body is:

In the event of a dispute, the Client must first submit a written complaint (by post or email), dated and reasoned, to Emanuele Santi EI, setting out the circumstances of the dispute and the requested remedy.

If no amicable solution is reached, the Client may refer the matter to the above-mentioned mediator provided that:

  • a written negative response has been received from Emanuele Santi EI; or

  • no response has been received within two (2) months of sending the complaint.
